UVA Says Lawsuit on Climate Change Research is Flawed

The University of Virginia says Attorney General Ken Cuccinelli's investigation of a former professor's climate change research is flawed and shouldn't be allowed under the state fraud act.

The school filed a brief Tuesday about Cuccinelli's inquiry of whether Michael Mann defrauded taxpayers by seeking state funds for his research. Mann left UVA in 2005 and now works at Pennsylvania State University.

Cuccinelli dismisses assertions that manmade gasses are causing the planet to warm. The Republican is seeking documents on five grants relating to global-warming research by Mann.

UVA says the investigation oversteps requirements of the fraud act and compliance would be burdensome.

Cuccinelli's office will respond to the brief next month, with a hearing scheduled in August.
