Lawsuit on VA Power Plant Moves Forward

A judge has refused to dismiss a lawsuit challenging permits issued for a proposed coal-burning power plant in Surry County.

The Daily Press reports that Surry Circuit Judge Samuel Campbell denied Old Dominion Electric Cooperative's request to dismiss the lawsuit late Tuesday.

Four residents filed the lawsuit last year after the Dendron Town Council approved permits for the $6 billion project. The lawsuit claims legal ads published before a public hearing didn't include proper information.

Old Dominion spokesman Jeb Hockman said the Town Council provided extensive public notice. He says the utility believes the case is without merit.

The Surry County Board of Supervisors also approved permits for the 1,500-megawatt plant.
