Massey Energy Co. and environmental groups have agreed to settle a water pollution lawsuit filed last year.
The Charleston Gazette reports that under the proposed settlement, Virginia-based Massey would donate $400,000 to a West Virginia University College of Law conservation project.
The Sierra Club and three other environmental groups sued five Massey subsidiaries in April 2010. The federal lawsuit alleged the companies routinely put profits before the people of West Virginia. The suit cited more than 3,000 violations of the Clean Water Act and surface mining laws.
The proposed settlement sets up a schedule of automatic fines for future violations.
The consent decree, which was filed with U.S. District Court in Charleston, is subject to a review period and must still be approved by a judge.
