The Supreme Court has agreed to rule on whether lethal injection amounts to cruel and unusual punishment.

The high court will hear the case of two death row inmates from Kentucky in determining the constitutionality of that form of capital punishment.

One of the men, convicted killer Ralph Baze, was scheduled to be executed Tuesday night, but the Kentucky Supreme court halted it earlier this month.

The defense attorney for the inmates says this will be one of the "most important" death penalty cases in decades.
