STAUNTON, Va –- Back in March, Police say Nicholas Rilee shot and killed his friend, Ricky, in Staunton. Rilee told police it was an accident.

Wednesday, at a preliminary hearing, witnesses said Rilee and Ricky were best friends. Staunton Police said the accident happened after a night of drinking, smoking marijuana and snorting crushed Tylenol.

Police also said Rilee called for help and tried to stop Ricky from bleeding. Commonwealth's Attorney Ray Robertson hoped the community will learn from this case.

“The thing is you don't mix guns with alcohol and drugs and you try to act as a responsible citizen. You don't go around partying at 3 or 4 in the morning and getting yourself in a situation like this,” said Robertson.

Rilee said he was using his father's revolver, that he took from a gun safe, when he shot Ricky.
