Under Virginia law, the family of Augusta County man, Jonah Brown, has a right to sue on behalf of their son even though he was an adult.
David O'Donnell, attorney-at-law, explained.
"Wrongful death is a little bit different because the person who is normally the plaintiff is dead, so it passes the right of action on to surviving relatives," O’Donnell said.
Brown was a back seat passenger in a car driven by Michael Jones of Waynesboro. Police said Brown, Jones and a friend had been drinking at a party before driving home. Jones lost control of the car and hit a large lot on Route 624 in Lyndhurst.
Brown was killed and one other passenger was injured. Jones faces manslaughter charges and is now out on bail.
