A former Wal-Mart worker in Winchester is suing the company for $1 million, claiming it failed to discipline an employee who he says made offensive and racist remarks.
Robert H. Polk of West Virginia claims that one of his co-workers in the meat department harassed him with racially offensive comments over the span of about a year.
He claims the harassment escalated after the two men met with three managers at the Winchester superstore and that he eventually was assaulted by the co-worker, William Wilson. A judge fined Wilson $100 for the assault.
Polk says he was fired in February for using foul and abusive language even though he has received positive work evaluations. Wilson is NOT named in the suit.
