Acting U.S. Attorney for the Western District of Virginia Julie Dudley made the following statement Thursday at a press conference concerning indictments against Page County Sheriff Daniel Presgraves:

"Good afternoon. I am Julie Dudley, Acting U.S. Attorney for the Western District of Virginia. Thank you all for being here.

"Before we get started I would like to introduce several members of the law enforcement community whose agents played critical roles in investigating the cases you will soon hear about. I am honored to be joined here today by the Special Agent in Charge of the FBI’s Richmond Division, Jennifer Smith Love, the Special Agent in Charge for the Internal Revenue Service’s Criminal Investigations Division, Andre Martin and the Special Agent in Charge of the Northeast Region for the Department of Agriculture, Brian L. Haaser. I am also pleased to be joined by members of our prosecution team, Criminal Chief of the Western District of Virginia, Thomas Bondurant and Assistant United States Attorney Zach Lee.

"Public service is a public trust and those who are elected to public office are held to the highest legal, moral and ethical standards. It’s what we all want and what we all expect. It’s a very sad day when we have to stand before you to report that a federal grand jury has found sufficient cause to return an indictment against an elected public official. Such action signals a violation of what we all hold sacred, the trust we put in our elected officials to do on a daily basis what is just, proper and lawful.

"Yesterday, a Federal Grand Jury sitting in Abingdon, Virginia returned a 22-count indictment which charged Page County Sheriff Daniel W. Presgraves with committing a variety of criminal acts which, if proven, constitute serious abuses of his power as Sheriff and a violation of the trust placed in him by the citizens of Page County.

"Early this morning, Sheriff Presgraves was arrested at his home in Luray by Federal Agents. He will appear before magistrate Judge B. Waugh Crigler later this afternoon.

"The investigation into the alleged criminal activity of Sheriff Presgraves began when an informant came forward with information that suggested the Sheriff was taking bribes from the operators of a Page County cockfighting pit known as Little Boxwood. As many of you are aware, the operators of that cockfighting pit have already been charged; some have pleaded guilty and have been sentenced. One remains on bond awaiting trial.

"As a result of this information, an undercover agent from the United States Department of Agriculture was introduced to individuals associated with the cockfighting pit, playing the role of a potential purchaser of Little Boxwood.

"During his undercover work, the agent expressed concern to the operators of the cockfighting pit about the potential for law enforcement to interfere with the operation of Little Boxwood. However, the agent was assured that if he made a $500 donation to an associate of Sheriff Presgraves, who in turn would give the money to the Sheriff, there would be no interference from local law enforcement.

"According to the indictment, Presgraves was aware of the cockfighting pit and, by allegedly taking bribes and steering law enforcement away from it, was a member of the conspiracy that kept Little Boxwood in operation.

"Alone, the allegation that an elected official took bribes from the operators of an illegal cockfighting pit is a serious claim. However, bribes were just the tip of the iceberg; just the outer layer of broader criminal conduct uncovered throughout the course of this investigation.

"As can be gleaned from the indictment, Mr. Presgraves engaged in a pattern of sexual assault, sexual harassment, money laundering, witness intimidation, acts of dishonesty and obstruction of justice.

"Included in the indictment are charges that Sheriff Presgraves abused his power over 12 female subordinate employees by verbally and physically sexually harassing and sexually assaulting them. All of the victims were employees of the Page County Sheriff’s Office when this conduct occurred.

"The indictment further charges him with multiple counts of obstruction of justice which stem from the allegations by several victims that Sheriff Presgraves attempted to use his power and position to convince them not to speak with investigators and to refuse to appear before a Federal Grand Jury. Presgraves allegedly told his victims that whatever information they had about him that could be useful to the “Feds” should be taken “to the grave.”

"In addition to the bribes Sheriff Presgraves allegedly took from the operators of Little Boxwood, he is also charged with taking bribes from a local corporation. The name of that corporation is not included in the indictment and will not be disclosed here today. These bribes included cash, gift cards, the use of earth moving machines and free labor for his personal use.

"In exchange for these gifts, the indictment charges that Sheriff Presgraves made a pledge to officials from the corporation that he would tip them off about any investigations by law enforcement into their dealings. The indictment states that he also promised to use his power as Sheriff to intimidate witnesses planning to cooperate with any investigations into the corporation.

"The indictment charges Sheriff Presgraves with diverting large amounts of revenue received by the Page County Sheriff’s Office into an escrow account over which he, rather than the County Treasurer, had control. Specifically, the sheriff’s office received $39,000 from the United States Customs Service and $47,000 from PayTel, a company contracted to install payphones at the Page County Jail.

"Between 2001 and 2004, over $100,000 in cash was deposited and unlawfully structured into personal checking accounts associated with Sheriff Presgraves. To avoid having the requisite Currency Transaction Reports filed with the banks, Presgraves never deposited more than $10,000 cash during any one transaction.

"One of Sheriff’s Presgraves’ duties as the top law enforcement official in the county is the supervision of the Page County Jail, its employees and inmates. This investigation revealed multiple instances where the Sheriff abused the power he held over some of the inmates housed at the Page County Jail.

"The indictment charges that on multiple occasions, Sheriff Presgraves, and others acting at his direction transported inmates from the Page County Jail to the Presgraves’ private residence or to other properties in which he or his family had a vested financial interest, for the purpose of performing personal work.

"To ensure certain inmates were not transferred from the Page County Jail, Presgraves allegedly contacted the Virginia Department of Corrections on multiple occasions and convinced officials with that agency that these inmates should remain under his custody. Presgraves did not disclose to the Virginia Department of Corrections that these particular inmates were performing personal work for him or his family.

"These various allegations of criminal activity uncovered during this time consuming and thorough investigation were presented to the Grand Jury and the Grand Jury has returned this indictment.

"It is imperative that the men and women of Page County and all across the Commonwealth of Virginia know that the people trusted to enforce our local, state and federal laws are doing so in a fair and responsible manner. They must know that their elected officials are being held to the highest legal and ethical standards. And they must know that when even high ranking members of the law enforcement community are accused of breaking the law, they will be prosecuted.

"I am proud of all the men and women from the FBI, IRS, the Department of Agriculture, the Virginia State Police and any other agencies that aided in the investigation into this matter.

"In a separate indictment returned yesterday this week and unsealed this morning, a Federal Grand Jury has charged Chester William Fannon III and the Virginia Gamefowl Breeders Association were indicted on charges related to conspiracy, making false statements and money laundering.

"Investigation into Fannon, the president of the VGBA, revealed that he was allegedly making campaign contributions to candidates for public office on behalf of the VGBA. Fannon would make contributions using his personal funds and later be reimbursed by the VGBA, a violation of federal law.

"These contributions were made to candidates the VGBA felt would work to repeal laws making it illegal to engage in cockfighting or at least fight laws that would enhance the penalties for participating in cockfighting.

"Fannon is accused of making over $11,000 of illegal contributions to various candidates on behalf of the VGBA."

Neil: You forgot to quote this. It also appeared in the paper and the indictment. Presgraves allegedly told his victims that whatever information they had about him that could be useful to the “Feds” should be taken “to the grave.”

Reading all this, my shame is greatest for those who make a decision based on an indictment before a trial. Shame on you all for that. He deserves a fair trial, then form your opinion. LOOK THIS UP PEOPLE,,,RICO ACT,,,,the feds can make a case based on HEARSAY only,,NO proof needed,,they can threatened your home, your family, taking your kids away, then offer to make it "all go away" if you tell them "what we want to hear". Then THEY tell YOU what they want to hear,they don't care for truth, they just want their case. Ask around, you will find many who can verify what I say.Go ask a lawyer to explain it to you,,,then come back here and tell us the feds don't make up charges for no reason,,,ha,,you are the ones with your heads in the sand,,not the people who feel a FAIR trial should come first.Educate yourselves BEFORE you put your fingers to the keyboard or open your mouth,,,and by the way,,what really did happen to CB's Dad years ago,,ask Chuckie boy,,,HE knows!!

I think that the letter being send to all county residents is terriable. Why would anyone want to help this crimnal. He did the crime now let him pay the time. He is a disgrace to this county and too all of the people county. I hope he rots in jail.

I am hghly ofended with the letter that is being send around to all residents of page county asking for money to pay for Danny presgraves attorney. How dare these people send this jug through the us mail. And to the people that are dong this you need to wake up...this man has taken enough and runied enough lives of the people of page county. I do not see how anyone could support him you are probably people that have not lived in page county all of your life!!

My prayer's are with Danny and his family. I have not forgotten the good, that Danny has done for our community. I have not read the paper's, however the talk of the town just seem's to indicate to me, that our sheriff is a human being. He has not been found guilty of anything. And all you good folk's that have found him guilty, your day will come.

most everyone knew this was coming. it is not a sad day for presgraves or his wife, only the honest citizens of page county. yes there are a few still here. i believe he is guilty. i have known him and his family all my life, school years on up, and i believe with all my heart he is guilty.

Although Danny has done a great job as sheriff, there are a lot of other things that have to be considered,like breaking the law. There has to be a lot of truth in all this, after all....why would all twelve ladies be lying, and I'm sure that the FBI has better things to do then to TRY to find something on him. Putting his brother-in-law in charge now is quite a twist, don't you think he's been involved in any of this, or has knowledge of it??? It should be very interesting to watch all of this unfold, and find out who else is involved in this mess.

I think that everyone needs to let the courts decide this case.I am no goody two shoes,but i do know that it is painful for all parties involved in this case to listen to all of the gossip.

It is just as bad to lie and not cheat on your spouse as it is to cheat. A lot of cheaters admit what they do while others cheat & lie about it. A lot of lairs & gossips talk about everyone else about their cheating while they are lusting themselves. They talk about people for living together even though they have had sex before marriage or committed adultry while married. They talk about so & so having a child out of wedlock even though they had sex before marriage & didn't get caught. Or they say did you hear about so & so's baby, it isn't their husband's... Who cares? Some of you who claim never to have cheated, you may have been seen on a back road or in your own home. This is not just about cheating. OMG read the indictments. Love, honor, cherish... What happens when you no longer love, honor, and cherish? My friend, you have broken your vows also, do not look down on someone else until you remove the plank from your own eye! This is about fair treatment!

All of you that are standing by Danny need to thank about the way he has made this community appear to other counties. 1st of all I can say I did not vote for him because he is not as great and invisable as some of you want to pretend. Fact is in Page County most of you want to gossip and black ball anyone else that may get in the smallest amount of trouble or the ones that are running with someone else. Fact is wake up all of you that think Danny is so great...Hiding behind all the wonderful things that he has done was just a good cover-up for what he was doing.Attending all those funerals, taking people here and there, doing this and doing that for his community is just what I said a cover up. So quit feeling sorry for Danny and thinking that he is so wonderful and start looking at the facts. Are you going to feel the same way when the cops roll up and arrestes your neighbor for a less serious crime. I don't think so, you that are standing up for him will be one of the 1st to gossip.

I am sure that at least 2 of them are sweating bullets. also isn't Russell Montgomery his brother in law? and wern't his comments inappropriate when he said the constituents should expect the same public service as in the past?..isn't that the type of service that got the PCSO where they are. I have read some of the indictment concerning the twelve females who claim sexual harassment.I would like to know why they chose to stay and participate.If they chose to leave,then they wouldn't be so exact in their details There is no door strong enough to keep me there if i didn't want to stay.I question their morals.

Many families have paid for reversed calls from inmates in his jail. They are very expensive. If the sheriff received kick backs from these calls as noted in the charges, he stole from the people who elected him. I hope that is not the case.

There are many people today that don't see any problem with cheating on their spouse. The people that find it acceptable tend to conduct their lives in the form of a continuous cover up. They learn to lie to the point they believe their own lies. Eventually God has had enough and allows the cheaters to come crashing down. Some people must hit rock bottom to appreciate what they had. We all feel sorry for Danny, but Danny has no one to blame but himself. Look at this time as new day, Danny. Confess your sins and ask God for forgiveness and his Grace will grant your heart felt desire. Looking back is no longer an option for you. "Innocent Until Proven Guilty" _______________________________ I'll withhold comment until there is a conviction or an acquittal in this matter. I would only want the same for myself or for anyone else. This is a protection that is built in to our legal system and should be respected by us. Everyone is entitled to the same treatment. Sadly,...'Conviction by Media' seems to be on the rise lately. Remember that the feds acted in an unusually voracious way trying to force a local business owner into testifying against Presgraves. "we'll make this go away if you testify" was what I read in the paper. Their Raid and subsequent confiscations of money and property were defeated in court and they ended up having nothing to charge the business owner with, did they? It was all for the want of obtaining 'dirt' on Presgraves. So let it play out in court. Let him have his day. Let's see what the outcome is in the end.

Eileen, I would like to talk to you. Possibly other people will come forward if they feel they could find an honest attorney. God bless you for speaking out. To all the dishonest judges and attorneys: To everyone who feels that they are above the law. I say to you... Watch "Devil's Advocate". Woe to you! To all corrupt law enforcement officials: You are held to a higher standard than to disgrace the uniform of so many honest officers who have risked and dedicated their lives. How dare you break the laws that you were sworn to uphold. How dare you let people off based on their financial status (especially if gained from selling drugs) to benefit your own political or financial gain. Yes, we all have made mistakes. Thankfully mine were not against the law. I would be ashamed to wear a badge to uphold the law and disgrace it by doing the same things or far more than others who have been incarcerated. God bless all of the brave men and women who had the guts to do the right thing and step forward. I have tremendous respect for all of you! To Donna: We have all made mistakes. However,if any elected official has abused their power by breaking the very laws that they are sworn to uphold, then they should be held more accountable than others. Yes, I have made mistakes, however none of mine were against man's laws. If the allegations are true then he should be treated like anyone else who has ever been arrested. Did anyone else notice that they did not show if he was led away in handcuffs? Maybe, it was because they feel that he is above the law. God bless Page County and may He be with Presgraves and his family. BTW I am neither Democrat or Republican. I am not the judge but right is right and wrong is wrong. If true, he is no better than the people that he has held in his jail. They are human too! I've noticed that some of you have no compassion for them.

I fell victim to a horrible abuse of power from the Page County Sheriff's office in January 2005. The only one who believed my situation then was a private investigator from Charlottesville and a Va State Police officer. I am not saying that every police officer in Page County is corrupt. I am just saying that I experienced that absolute worst from the Sheriff's department in January 2005. Thank God for an incredible lawyer in Charlottesville and a wonderful Judge in Page Co....I survived my horrible nightmare. The corruption is REAL. Get your head out the sand and talk to me. I wanted to die at the time...Thank you God almighty...its over.

First, to our Sheriff and your family .. We are praying for you that God will keep you and your family strong through this difficult time. Second as I read some of the really ugly comments below I would love so to meet you...you must wear a "Halo" around your head. Halo...The ring of light shown around the head of a saint. There is not one person that deserves this "halo" other then our Lord Jesus Christ and NOT Monteleon, Jerry Baker or Pap Sedwick. It is truly funny to see how the people really stick together in Page County ha Yeah right! It is sickening to see how people relish in other peoples problems. Oh the "COCK FIGHTS" they have been in this county ever since I was little and I am 42 now, so that means they was going on even when the "BIG" Pap Sedwick was sheriff. I have lived in Page County all my life, and am not ashamed of it. I am embarrassed, however, by the decisions of some of the people that live here. Like putting someone back into office after knowing of the things that have been allowed to take place. This is a small county, and word spreads as quickly as the fires in the mountains in the fall. To say that the people that voted for Presgraves again didn't know what was going on is malarky. And, this isn't political at all, so all the McCain/Obama squawkers out there...please, be still! This is about someone we trusted, and he turned out to be a morally bad person. We try to teach our children to uphold the law, to respect the law and its officers. Are we teaching them to respect this? Anyone who lives in the county, and especially anyone who has children that will someday be our leaders, should stand up and cry for his resignation.

I have heard that the sheriff has been charged..not convicted of these charges. I reserve the right to formulate an opinion until after all the evidence has been heard and proven. I believe that is the way our justice system is supposed to work isn't it? Until he is proven guilty, I will maintain my faith in our sheriff. Evidence can be twisted any number of ways for different charges (such as the IBR fiasco) and Sheriff Presgraves did not shoot himself in the foot serving a search warrant on an unarmed female in her home. I will keep an open mind until there are convictions.

I don't care what they have against Danny, you will never lead me to believe that he is a bad person and that most of this stuff is true! This all revolves around the cock fighting then well who cares that's been going on for years and the only reason it isn't legal is because the goverment can't get there hands in it! People in this kind of power FBI, State Police, Dept of Ag can also create things if they want to bad enough. I think they were just upset because they have been trying to get Danny for so long and couldn't so maybe there is more to this than meets the eye! It is great that a public official abusing his/her power will be held accountable for their actions. So often we hear about abuse of power going un-noticed that we start to lose faith in our government.
