More Trespassing Arrests at Massey Mine

For the second time in as many weeks, protesters at a Massey Energy mine have been arrested and charged with misdemeanor trespassing.

For the second time in as many weeks, protesters at a Massey Energy mine have been arrested and charged with misdemeanor trespassing.

State Police arrested James Gerard McGinness of Montegut, Louisiana and Michael Roselle of Rock Creek, on Monday after they stood before a bulldozer at Massey's Performance Coal Co.'s operation in Boone County.

The two were also arrested on February 3 with 11 others after they chained themselves to equipment at Marfork Coal Co.

The group is protesting Richmond, Virginia-based Massey's plan to mine Coal River Mountain rather then develop a wind farm on its ridgetops.

State Police Sgt. Michael Smith said the two were arrested and released.

A Massey spokesman said protesters put themselves and others at risk when they enter mine property.
