West Virginia's Lottery is not ready to shut down one of its largest providers of video lottery machines in the wake of a federal indictment.

Southern Amusement and its owner, Joe C. Ferrell, face 48 felony counts alleging several offenses including illegal gambling.

A federal judge has ordered Ferrell's assets preserved, including the company and its 675 video lottery machines. That's because prosecutors want to seize Ferrell's assets if he's convicted.

The Lottery Commission referred to that order Wednesday before deciding to hold off suspending Southern Amusement.

It instead wants the attorney general's office to seek approval of a suspension from the federal court.

Southern Amusement currently generates $2.3 million a month from its machines.
