WV Legislators Want Court's OK Before Approving PATH Tax
CHARLESTON, W.Va. (AP) Some West Virginia lawmakers want the state Supreme Court's OK before they tax new high-voltage power lines.

Some West Virginia lawmakers want the state Supreme Court's OK before they tax new high-voltage power lines.
But a lawyer for the Public Service Commission told a legislative interim committee Tuesday that the high court is unlikely to weigh in before any bill is passed.
Gov. Joe Manchin proposed the tax in the wake of a pair of proposed transmission line projects that would cross through the state.
But the bill failed during this year's session, amid concerns that it would violate the U.S. Constitution's protection of interstate commerce.
Lawmakers also suggested that state regulators delay their review of one project, the Potomac-Appalachian Transmission Highline or PATH. Their Maryland counters rejected PATH's application in that state last week.
