A fifth man indicted with 55 members and associates of the Pagans Motorcycle Club is pleading guilty.

Court records show 47-year-old Alexandria, Virginia resident John Maggio is scheduled to plead guilty Tuesday in Charleston.

Maggio faces a single extortion charge in a 44-count federal indictment accusing Pagans members and associates from West Virginia, Kentucky, Virginia, Pennsylvania, New York, New Jersey, Delaware and Florida of murder conspiracy, kidnapping and other charges.

Maggio is charged with conspiring with indicted club vice president Floyd "Jesse" Moore and an unnamed conspirator in an extortion plot last fall in the St. Albans area.

Four of Maggio's co-defendants have pleaded guilty and agreed to cooperate. Court records don't indicate whether Maggio is cooperating.

WHSV Poll
A committee in the House of Delegates has sent a bill to the House floor that would allow private, faith-based adoption agencies to discriminate against prospective parents based on their sexual orientation. Would you support this?

Yes, I think if it is a private organization it's okay.
No, there should be no discrimination.
It should depend on a case by case basis.
