A Nottoway County grand jury indicted three people Tuesday for conspiracy to commit capital murder-for-hire in connection with the death of Berryville Town Council member Gail Smith.

Fifty-year-old Timothy Smith Jr., 39-year-old Edward Visosky III and 32-year-old Edward Poley were indicted for conspiracy to commit murder for hire with Gail Smith as the murder target.

Timothy is Gail's brother.

Once authorities uncovered the alleged conspiracy during their investigation following Smith's death, they turned the information over to the Nottoway County Commonwealth's Attorney Office so formal charges to be filed in the jurisdiction where the conspiracy allegedly occurred.

Authorities say the plot developed before Smith's July 30 murder. She was found dead in her home.

Law enforcement agencies from multiple jurisdictions are still investigating the case.
