The Supreme Court is refusing to block Virginia from executing Larry Bill Elliott, who is set to die Tuesday in the state's electric chair.
The justices offered no comment Monday in turning down Elliott's request to halt his execution.
Justices Ruth Bader Ginsburg, Sonia Sotomayor and John Paul Stevens voted to stop the execution.
Elliott would be the first person to die of electrocution in the United States this year and in Virginia since 2006.
He was given the death penalty for the January 2001 shooting deaths of 25-year-old Dana Thrall and 30-year-old Robert Finch. Prosecutors say Elliott killed the couple to win the love of former stripper and escort Rebecca Gragg, who was involved in a custody dispute with Finch.
Elliott's execution comes a week after sniper mastermind John Allen Muhammad died by injection. Elliott chose electrocution, something only four inmates have chosen since they were given the choice in 1995.
