WV Judge Asks for Advice Concerning Damaged Graves Case

A Logan County judge wants advice from the West Virginia Supreme Court on a lawsuit alleging damage to a cemetery in a historically black coal camp community.

A Logan County judge wants advice from the West Virginia Supreme Court on a lawsuit alleging damage to a cemetery in a historically black coal camp community.

Circuit Judge Roger Perry is seeking guidance from the high court on whether there are grounds for a lawsuit, what the plaintiffs have to prove and what damages can be awarded.

Relatives of people buried in Crystal Block Cemetery near Sarah Ann say a natural gas pipeline project for the EQT company has damaged graves there.

This is new legal territory in West Virginia, since the state's highest court has never ruled on such a case before.

A spokesman for Pittsburgh-based EQT says there's no evidence any of the graves have been disturbed.
