The lawyer for 24-year-old Melvin Humphries questioned why on three different occasions to ask for help, 21-year-old Christine Burke didn't.
He wondered why she did not ask for help at a gas station where she paid for gas while Humphries waited in the car.
Second, Burke acknowledged she didn't ask for help while at Humphries grandparents house in West Virgina when he went to bed 30 minutes before she did.
And finally, when his grandparents received a phone call about the incident from his uncle, Burke still did not ask for help from them.
The judge decided to certify the case and send it before a grand jury on September 27th.
Humphries faces charges of abduction and use and display of a firearm.
