WV Landlord in Environmental Trouble

A West Virginia landlord is in hot water with federal and state environmental regulators.
Fairmont resident Tom Deavers was arrested Thursday on misdemeanor charges. Authorities have accused him of violating garbage laws at an apartment complex in Marion County.
But Assistant County Prosecuting Attorney Charles Shields says the U.S. Environmental Protection Agency and state Department of Environmental Protection are investigating possible felony charges.
Shields says investigators are looking into whether Deavers allowed garbage to pile up at the complex for two months and whether the building's sewage system allowed waste to flow into a nearby river. Shields’ says both are potential violations of state and federal law.
The city of Fairmont, meanwhile, closed another apartment owned by Deavers and evicted 12 tenants this week. City Manager Bruce McDaniel says code violations were discovered after the building's electricity was shut off because of delinquent payments.
Deavers did not immediately return a phone message Friday.
