HARRISONBURG -- A retrial is set for the teen convicted of involuntary manslaughter after crashing and killing a baby in the Belmont Estates neighborhood last August.
On Thursday, a judge went over what evidence could be used in the retrial, which is set for Friday.
The judge allowed pictures from the scene of the crash to be entered as evidence. He also decided no one will be able to wear T-shirts or pins supporting the victim in court. That way a jury isn't swayed one way before hearing the evidence.
The teen's attorney appealed the case because he said the teen could not see out his windshield and that the crash was just an accident.
A judge ruled the teen guilty of involuntary manslaughter because speeding was a factor.
