HARRISONBURG, Va. (WHSV) -- When sidewalks are not cleared, some crooks may look to take advantage.

It's called the slip and fall scam and in some places it could earn crooks big cash at your expense.

If you slip and fall in front of a business, it may be liable.

Some people across the U.S. are doing it as a way to make money, but in Virginia, if it is obvious there is snow or ice and you still walk on it, you cannot complain.

"You have to prove the owner of the business had knowledge of the problem that they did not do anything to remedy that problem," said John Krall, an attorney with the Ritchie Law Firm.

In Harrisonburg, businesses have to clean in front of the stores within three hours after the snow stops falling or if the snowfall happened at night, sidewalks have to be clear by 10 a.m.

If that doesn't happen, police can call to have the area scraped and charge the business with the bill.
