RICHMOND, Va. (AP) -- The Virginia attorney general's office says it won't seek further review of a court's decision vacating a death row inmate's conviction and sentence.
The state did not oppose an order Friday finalizing a federal appeals court decision in Justin Wolfe's case. The attorney general's office said in an email to The Associated Press that further litigation would not change the result.
Wolfe was convicted of hiring someone to kill his marijuana supplier in 2001. The appeals court last month ruled that Wolfe's conviction should be vacated and he should be freed from prison because prosecutors withheld evidence that would have discredited their key witness.
Prince William County prosecutor Paul Ebert could retry Wolfe. He did not immediately return a voice mail message.
