HARRISONBURG, Va.---The future of the men's head volleyball coach at Eastern Mennonite University is uncertain.

Gary Moore faces one charge for sexual battery in Cheseapeake. Someone at his old job filed the charges for an incident in June 2012. Moore was not an employee at a school or coaching volleyball.

Vice-President for Student Life Ken Nafziger said the university is waiting for Moore's legal battle to be over before signing his contract for another year.

"Determining whether someone returns for a second season as a coach, it involves more than just an incident such as this," said Nafziger.

According to Nafziger, Moore was not aware of the allegations until February when he became aware of a warrant for his arrest.

"That was the first that he was aware of these allegations and immediately he called me and his immediate supervisor," said Nafziger.

He said each case is different but if an employee faces felony charges and does not come forward, the employee is put on administrative leave.

According to Nafziger, the university wants to give Moore the benefit of the doubt.

"We want to take them very seriously and make sure we're looking out for the safety of our students and also making sure that we don't make a rush judgement on what is going on with the particular person who is charged," said Nafziger.

In addition, Nafziger said students on the men's volleyball team found out about the allegations, as soon as Moore came forward. The rest of the students received an email on Tuesday.

Students who did not agree to go on camera told WHSV, they are glad the university is giving Moore a chance to proof his innocence.

The university will have to decide whether to keep Moore for next season on August 1.
