A man accused of stabbing a Waynesboro man to death two months ago was supposed to have been deported for beating that same man nearly two years ago.
However, the Middle River Regional Jail says it didn't receive the necessary paperwork.
Jail officials say, in just the last two weeks, they received two separate requests to detain David Sanchez from Harrisonburg's Immigration and Customs Enforcement office.
One of the requests was dated January 7, 2009.
According to jail officials, it request was recently hand delivered.
They say Sanchez was first brought to Middle River Regional Jail for beating Eduardo Herrera-Bentancourt with a baseball bat.
Two other men brought in with Sanchez on the beating charge were deported after the jail received detainer requests for them.
However, jail officials say, during the 18 months Sanchez spent in jail, no detainer request was delivered, so he wasn't deported.
Sanchez was released from jail after serving his sentence, but he is now accused of murdering Herrera-Bentancourt.
Attempts to reach the ICE office for a comment on the detainer requests were unsuccessful.

Ignore the borders? You mean the safest borders in the past few years? And the highest deportation rate in the past several years? You've got a non-issue there, fella.
And ANOTHER citizen dies at the hands of an illegal while our federal government continues to ignore the boarders.
