Sounds like abandoned property to me, which is an exception to a search warrant!
Doesn't the city have enough problems to worry about than worrying about calling the cops if someone is getting cans out of a recycle bin?
If the recycle crew in Harrisonburg is anything like the joke they have in Staunton, I say let the people go through the bins and take what they can use! I quit recycling because we spent all that time pulling labels off cans, rinsing bottles and separating glass, just to have them smash the jars up in the street and drop the cans, which roll down the street and under cars and they don't even bother to clean it up. I say if poor people want to go through the trash and there is something in my trash they can use-HAVE AT IT and leave them alone!
I have a hard time believing that's the case...I believe it would be illegal to steal the recycling bin, but court's have found that it's not illegal for police officers, or others, to search and take items in trash containers out on the curb for use in judicial proceedings, so unless Harrisonburg has a ordinance against dumpster diving, stealing recyclable materials out of the recycling bins is probably NOT ILLEGAL.
