A day after being cited by the Virginia Department of Alcoholic Beverage Control in an initial decision, a popular Harrisonburg restaurant faces yet another charge.
The Pub's owners will go before an ABC administrative hearing officer again this month on a financial responsibility charge. ABC officials say the restaurant owes an outstanding debt or liability.
It's been a trying year for Bill Royer and his restaurant, the Pub. Following an ABC hearing in June, he'll pay a $1,750 civil penalty.
"I'm happy with the outcome. I think all the evidence was presented. The outcome was as good as it could have been," says Royer.
In the spring, his license was suspended for after-hours drinking violations.
"All the other publicity surrounding all of this, also I think had something to do with a downturn in our business," says Royer.
On Friday, Royer learned there's a new charge: failure to demonstrate financial responsibility.
"While not totally unusual, yes it is unusual to have that many charges against an establishment in a period of time," says Roger Stevens, special agent in charge for the Virginia ABC office in Staunton.
Stevens says this latest investigation into finances is separate from the after-hours drinking investigation.
The restaurant gained public attention when a Pub bartender was accused in the hit-and-run death of Sherry Anderson in January.
"We're not singling out the Pub. But, of the violations there, we are duty-bound and obligated to proceed forth to the hearing," says Stevens.
Royer recognizes he's made mistakes. He says he's also looking forward to the chance to defend his restaurant once again.
"They have to do their job. That's what the hearings are for, for us to be able to go in, present our side and show that we're not doing anything improper," says Royer.
The Pub's owners will go before an ABC administrative hearing officer on the 29th of this month. If found in violation, the fine ranges from a civil penalty to having the restaurant's license revoked.
