City to Use Eminent Domain Power on Reservoir Street Project

HARRISONBURG, Va.--- The city council approved a resolution on Tuesday to acquire the remaining land it needs for the Reservoir street Improvement Project. This would allow the city to take the parcels using its power of eminent domain.

Currently, 15 landowners have not reached an agreement to allow the city to buy 20 parcels.

The resolution would allow the city to file certificates of take in Circuit court and give landowners its offer.

Elizabeth Swallow owns a building on Reservoir street, but has not settled on an amount with the city yet.

"We are taxpayers and we know that the city is going to widen the road but we want to have a fair price for the land that the city is going to take. I think we are being discriminated against," said Swallow.

If landowners do not agree with the amount offered by the city, they could challenge it. After this, both parties could either reach a deal or they could go to trial.

This process would not delay the timeline of the project.
