West Virginia University wants a judge to dismiss some of the counterclaims Rich Rodriguez has made in a lawsuit over a $4 million buyout clause in his contract.

WVU filed documents late Friday in Monongalia County Circuit Court in Morgantown. They argue that Rodriguez eagerly accepted all the benefits of his contract, then cried foul when asked to meet his obligations.

WVU sued Rodriguez December 27 after he resigned to take the head coaching job at Michigan. That move touched off a bitter and continuing public feud.

WVU argues it's owed the full $4 million because Rodriguez broke his contract early.

Rodriguez says WVU broke its promises first, including one to either reduce or get rid of the buyout.
