An athletic group hopes their suit against the U.S. Department of Education and James Madison University makes it all the way to the U.S. Supreme Court.
Equity in Athletics filed a petition in the highest court this week. EIA formed in 2007 to sue the government after JMU cut ten men and women's sports to meet Title IX requirements.
An appellate court ruled against the athletics group saying the university was trying to comply with federal laws and EIA's suit was "merely a collateral attack" on Title IX.
Even if the Supreme Court denies the request, EIA may have other legal options. A case called "Fitzgerald v. Barnstable School Committee," which is a similar case to the one filed by EIA, is currently before the high court.
Depending how the justices rule in that case, the "EIA v. Department of Education, et al." could go back to the Fourth Circuit Court of Appeals for reevaluation.
