CHARLESTON, W.Va. (AP) A bar owner who is openly defying a county-wide smoking ban in West Virginia's capital city says he will gladly trade an ashtray for a can of green beans.

A bar owner who is openly defying a county-wide smoking ban in West Virginia's capital city says he will gladly trade an ashtray for a can of green beans.
Blackhawk Saloon owner Kerry "Paco" Ellison plans to reopens his bar on Wednesday, three weeks after it was damaged by fire. He also plans to ask patrons who want to light up to donate a canned good, toy or dollar bill, which he plans to donate to charity.
Ellison is one of five bar owners facing misdemeanor charges of ignoring Kanawha County smoking ban that took effect July 1.
Ellison says he is requesting donations because he's risking his business and wants something good to come from it.
