UPDATE (Sept. 14, 2017):

A former magistrate has pleaded guilty to sex and child porn charges.

70-year-old Houston Miller pleaded guilty to possession of child porn, three sex charges with a minor and a sexual battery charge.

Waynesboro Commonwealth's Attorney David Ledbetter said Houston could face 9 years in prison.

He'll be sentenced in December 13th.

UPDATE (Sept. 6, 2017):

A former magistrate could face more charges in a connection to sexual abuse of a teen.

Houston Miller of Augusta County was indicted earlier this year on charges that he and a woman sexually abused a teen for several months.

Right now Miller is charged with contributing to the delinquency of a minor, sexual battery, and possession of child pornography.

Waynesboro Commonwealth's Attorney, David Ledbetter said he will be re-interviewing the victim and then decide on additional charges.

A decision could be made by Tuesday.

UPDATE (May 9, 2017):

A Waynesboro couple has been indicted on several charges connected to the sexual abuse of a teenage girl over a 6-month period in 2016.

Houston Marion Miller, 69, and Kelly Denise Claytor, 45, were arrested by the Waynesboro Police Department on November 10, 2016.

Waynesboro Commonwealth Attorney David Ledbetter tells WHSV that Miller is a former Augusta County magistrate.

In November, the department said they had begun a criminal investigation after the victim told a friend's family she was being abused by Miller and Claytor, who are in a relationship together. The department's investigation found the victim had been sexually abused from May to early November, and, in addition, the couple was found to be in possession of child pornography, at least some of which had been produced by them.

Police are not releasing the age of the victim or her relationship with the suspects.

Miller faces three misdemeanor counts of Contributing to the Delinquency of a Minor, a misdemeanor count of Sexual Battery, and a felony count of Possession of Child Pornography.

Claytor faces a felony count of Child Neglect, a felony count Production of Child Pornography, and a felony count of Possession of Child Pornography.

Both suspects are out on bond and are awaiting their plea dates, which are set as May 31 for Claytor and July 31 for Miller.

Their bond was set with special conditions of house arrest, GPS ankle bracelet monitoring, and pretrial supervision by Blue Ridge Court Services.

They are prohibited from having any contact with each other or the victim.

ORIGINAL STORY (Nov. 12, 2016):

"Sexual abuse of [a] teenage girl that occurred over a six-month period beginning in early May 2016," led to the Nov. 10 arrests of Houston Marion Miller, 69, and Kelly Denise Claytor, 45, the Waynesboro Police Dept. said in a statement.

"Earlier this month the Police Department began a criminal investigation after the victim reported to a friend’s family about the abuse she was experiencing from Miller and Claytor, who are in a relationship together," said Sgt. Brian Edwards with the Waynesboro Police Dept.

"The investigation revealed that Miller and Claytor had been sexually abusing the victim from May to early November," Sgt. Edwards said. "In addition to the sexual abuse, both Miller and Claytor were found in possession of child pornography."

Sgt. Edwards said the two were sent to the Middle River Regional Jail, but also "will be released on bond with special conditions of house arrest, GPS ankle bracelet monitoring, and pretrial supervision by Blue Ridge Court Services."

Police said Kelly Denise Claytor faces charges including production of child pornography and also possession of child pornography. Houston Marion Miller's charges included sexual battery, possession of child pornography, and three counts of contributing to the delinquency of a minor.

The two are prohibited from having further contact with the victim —whose identity police intend to keep confidential. The victim's age and connection to the two charged will also not be disclosed.
